Absorption of “Temporary Employees” in LIC as per CGIT judgement & Supreme Court order

In this regard, Central Office has given instructions to the Zonal Offices by Vedio Conferencing and following information is provided by the concerned Zonal authorities of NCZO, Kanpur :-

1.) Only those Temporary Employees will be absorbed, who had worked in the corporation from 20.05.1985 to 04.03.1991 (both dates inclusive).

2.) For Class III minimum 85 days working is required & for Class IV minimum 70 days working is required.

3.) Besides that, Only those Temporary Employees are eligible who were petitioner in the I.D. No. 27 of 1991 in CGIT, New Delhi.

4.) Earlier on 21.07.2015 the corporation has issued Notification for such Temporary Employees, by which 11708 applications were received by the central office from all over India (out of which 903 applications were from NCZO).  Now the various lists of Temporary Employees received by the NCZO from CO has approximately 1500 names.

Notification in this regard will be issued very soon.

  2. Once again I read the judgement throughly I did not see any where in the judgement pronouncing any guidelines to follow at the time of absorption. The judement is common for all.precedent of the NIT also those who have worked in the cutoff period was given job without any trouble. Now Management has fixed three conditions in which I came to know that in Gujarath not even a single work men is qualified . what I feel is this absorption process laid down on the 3 conditions by management might be Challenged by the affected and aggrieved workmen thro their lawyers. So again we can see another one sue should be ahead. It will erode the name of the Corporation. The three conditions were laid down by the Management to filter the workmen. But this judgement is common for all please remember. LIC and workmen issues
    be never ending Process I feel.Comments are solicited .Feel free to comment. Most of the workmen not reading anything with respect to their rights. But without reading they demand everything.In NIT before 20/5/1985 AIIEA had conducted the CGIT case and represented for their temp workmen and sucessfully implemented and obtained the jobs for all workmen worked the said period. Why does this confusion prevails now ….EveryDay new rumours are comingout and Management neither refuse nor accept these rumours.. I do not know their work culture and why not they deny these rumours thro a press conference.
    Only difference is previous Awards recommended only job absorption. Here this judgement awarded 50% backwages and all monetary benefits. So Management filtered the workmen by lay down unneccesary Conditions. But its against judgement and fundamental rights of workmen.
    After dismissing curative petition now 3 months have passed.What decision they have made is yet to be announced to the Respondents. My worry is our countries biggest organisation having a very big trade unionists is going for eroding their name. Financially strong organisation and having good bussiness should folow the labour laws strictly.

      We appreciate your initiative to go for contempt petition, at the same time you are demanding to observe those employees who worked between 20/05/1985 to 09/08/2016 (CGIT Award).

      Please clarify, what about employees who worked between 01-01-1982 to 20-05-1985 (NIT Award) and not observed due to less number of days and subsequently obtained required number of days, i.e.,
      In the NIT award : 45 days (01-01-1982 to 20-05-1985)
      In the CGIT award : 40 days (from 20-05-1985 to 1991)
      Total number of days : 85 in any two calendar years
      NIT Award is still operative as per judgement
      CGIT Award is legal and valid as per judgement

      I hope some of the employees might be a petitioner in the above case who fall in both the awards.

      Please include the above category of employees in your demand.

        Please note that the date mentioned above is error. CGIT Award here refers only 20/5/1985 to 04/03/1991 only .All other comments 100% I agree with you Mr.Ravi.

          I also know CGIT award refer only 20-05-1985 to 04-03-1991, but union demands upto 09.08.2016.

            the demanding union has to pronounce that CGIT period from 20/5/85 to 4/3/1991 and NON-CGIT period from 4/3/1991 to the SCI judgement date. It is the correct interpretation. Is it not?

            As per judgement who ever worked 85 / 70 days are eligible, date is only to refer the period from 20/5/1985, because those who worked before 20/05/1985 got the placement on the same ground hence others similarly place should be given that is the essence of the judgment.

            As per your statement LIC is going to implement judgement first for CGIT petitioners and then others. But after 3 months of curative dismissal there is no symptom of absorption from Management. Management so far did not display any rules or guidelines for implementation.thats why lucknowlife filed contempt now.

      2. You are perfectly eligible. No doubt at all. But you must be a member of the both the NIT and CGIT award. Means your name should be there in both the list.

  4. All the workmen who worked between 1985-1991(85-70 days) must be absorbed without imposing the conditions which are arbitrary unlawful and against the order.Not a single word or coma or full stop can be added in the verdict passed by SC.

      I have worked 85 days as per the notification of LIC on 21/07/2015. But I don’t remember that whether my name is there in the petitioners’ list or not. On the circumstances enunciated above, should I except a job in LIC as per the SC order.

    sir, i have worked as Assistant in LIC from 2-11-1990 to 25-01-1991 i.e., 85 days as temporary employee. But i have seen the notification issued by CGIT, even though i have applied for job, but the postal cover not reached within time. there is any chance to get job in LIC. I have all the originals with me. please send any reply to me.

    1. Hello Raoji, Here you have forgotten to mention one important matter. Those whose name is there in CGIT 27/1991 Award list they are only getting verification orders (from division wise). You did not mention that your name is there or not in the list. First you might clear this..Then I shall reply.

  9. Almost big Sanghs are filed contempt petitions in SCI. Now We have to wait till the judgments has to arrive. What ever the justice we will accept it since Supreme court never pronounce injustice to all workmen. Let paray GOD for our Sucess

    1. you have to approach the Honourable Supreme Court by way of filing of Contempt Petition to enable you to get absorption.

    I have worked from July 1993 to September 1993 – 85 days. When I checked with LIC Div,Office I found my name in application submitted list. It is found that only till 91 is absorbed. So…. what should we do.

  22. we request you to Union leaders, speed up the Temporary employees absorb process , last five months back some thing work going positively, now every thing slow down why?
    when contempt petition come to result ?

    first priority CGIt period whoever worked for them Union has to act fastly. Every body eagerly waiting for positive response from Our storng union leaders efforts……

    We hope by this month end we will get the good news to all. Now a days existing employees pay-revision is there , i think they may be concentrate on that issues, we request you to all Union members, Please take care of Temporary employees absorb is the first priority.

  23. Please discuss with Management priority basis first consider cgit period 85 to 91 and if any negotiations required for backlog payments etc.., please negotiate reasonable manner and majority temporary employees expected pensionable employment first priority.

    Recently Management has filed Affidavit in SC, defending that only 242 candidates are covered under chit. How is it possible? Candidates who are working between 85 and 91 for 85 days are simply ignored? I have worked in 1988/89 for 85 days and having all documents, also applied against the notification issued by LIC in, 2015. But I surprised that I am not covered under cgit? How is it possible Sir, that’s why approached All India Life Union by sending all my papers, for justice. I request Life Union to negotiate with management regarding this issue and do needful to me. I am from AP, I think no petitioner is there here to look into our case.
